These General Terms and Conditions, hereinafter referred to as GTC, regulate the conditions of purchase of the different products offered on this website, owned by Premium Brand España SL, with CIF B-64513690 and address at Avenida de Gaudí 267, CP 08191, Rubí, Barcelona, Spain..

Users who make purchases on this website fully accept these GTC and will be bound by them as they are drafted at the time of contracting. It will be an essential requirement to read and accept the GTC prior to the purchase of any product through this website.

Premium Brand España SL reserves the right to modify the GTC, at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.

Only persons over 18 years of age with sufficient capacity to contract may purchase products from this website.

Purchase procedure

The purchase process is very simple, whether it is the first time you buy on this website or if you have already purchased before, as no prior registration is required.

1) CHOOSE PRODUCTS: Choose the desired product, and you will see a detailed description of the product and its price (VAT included). Clicking on "Add to cart", it will be added to the shopping cart.

2) PURCHASE: Once you have all the items you wish to purchase in your cart and the next step will be to process the order and make the payment. To do this:

Click on the "Shopping Cart" icon at the top of the page.
2. Click on the "Checkout" button.
3. Fill in or check the contact information, the details of your order, the address to which you want the order to be sent and the address to which the invoice should be sent.
4. Choose your payment method: debit/credit card, Bizum or PayPal.
5. Read and accept the general terms and conditions of the site.

3) CONFIRMATION: Click on the "Place Order" button.

Upon completion of your order, you will be sent an email confirming receipt of your order, and specifying all the details of the order, e.g., the chosen method of payment, shipping address indicated. If you notice an error in the indicated address or in any other point of the order, you must immediately notify web@havanna.com.es to proceed to correct the error.


All prices shown on the website are inclusive of VAT. However, you will see the breakdown of the price and VAT before finalizing the order.

We reserve the right to modify prices at any time, always respecting the price indicated at the time of purchase.

Methods of payment


The customer may choose to pay by credit card, the transaction being carried out at the time of placing the order.

This website uses the system called SSL (Secure Sockets Layer), a payment system in a secure environment that allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.

As a measure of protection against fraud, Premium Brand España SL may request by email to customers to send additional documentation to certify the identity of the buyer as the lawful owner of the credit card. Such accreditation may be attached digitally in pdf or jpg format in the same email in which it is requested, to expedite the validation of the order and proceed to its shipment as soon as possible.


The customer can choose to pay by PAYPAL if he/she has an account. The charge will appear in your PAYPAL account as PREMIUM BRAND ESPAÑA SL. PAYPAL ensures that the payment is secure.


To pay with Bizum the bank used by the customer must have this option active, it is called e-commerce. When this payment method is chosen on the website, a 4-digit password must be entered, which has been previously configured in the bank's application.


Shipping costs and delivery times

Shipping costs in Spain Peninsula:

Prices do not include shipping or communication costs, or complementary services, unless otherwise expressly agreed in writing.

The shipping costs will be calculated at the moment of saving the basket or quotation, and are specified in it, before making the purchase and entering data, just by selecting the country and/or province of destination. The shipping cost is calculated according to the weight of the products.

  • 6,05 € for peninsular shipments weighing less than 2 Kg.
  • FREE DELIVERY (Web orders only) Free only in standard shipping and orders over 55€ in mainland Spain, 95€ in Balearic Islands, 75€ in Portugal and 130€ in the rest of Europe.

Courier company

The delivery time is usually between 24-48h in Spain and Portugal peninsular, 48-96h in Balearic Islands and 5 working days for European orders (depending on the destination town and the chosen payment method). This term is understood as long as it has been confirmed by email that the order has been completed once the availability of the goods has been verified and the payment has been confirmed.

Once you have confirmed that your Havanna Shop order is complete, you can check the status of your order by clicking on the button at the top-right of the web store or by sending us an email to web@havanna.com.es indicating your order number and the email address with which it was placed. Our team will provide you with the tracking number and the link to the courier company's website.

Note 1: You may receive your order before the minimum time indicated.

Note 2: there are towns in which the transport company delivers one day of the week because they are sparsely populated.

If at the time of collection/delivery you are not present at the address indicated, if possible, the transport company will leave a notice so that you can contact them and arrange a new date and time of delivery. The price of the transport service includes up to 2 attempts of delivery at home and a 3rd attempt of collection at the office of the agency, in case of absence and consequent return, Premium Brand España SL reserves the right to apply the costs of return and shipping originated by the non-receipt of the order by the customer.

Receipt of order

If at the time of delivery is appreciated in a visible and clear, without the need to manipulate the shipping packaging or the product itself, that a product has defects caused by damage caused by transport or is appreciated, in the same way, an error in the goods received, the Client will have to consign it in the delivery note and communicate it to Premium Brand España SL (by means of e-mail directed to the address web@havanna.com.es in the shortest possible term from the reception of the order and never superior to 1 working day from the reception, to be able to urge the return of the product or products affected and to proceed to the substitution for another one in optimal conditions or, to realize the refund of the price paid by the same one, as it indicates us in the above mentioned e-mail. (See section "RETURNS")


The food products sent by tienda.havanna.com.es are in perfect condition. All products offered in our online store have a guarantee of 30 calendar days from the date of delivery and in accordance with current legislation.

In any case, it should be borne in mind that, since these are food products, the warranty of these products will be limited by the corresponding expiration dates.

The warranty does not cover damages or flaws caused by misuse, incorrect handling or those derived from the ordinary use of the object.

In compliance with the provisions of Article 14.1 of Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013, in the event that the buyer has the status of consumer, we inform you of the existence of an out-of-court online dispute resolution platform made available by the European Commission, available at:

Returns and exchanges

Cancel or modify your order

It is possible to cancel or make changes to your order before it is shipped.

To cancel your order, please contact us and we will cancel the order immediately.

To change or cancel products in an order, please contact us and let us know what changes you need. We are unable to add products due to payment authorization limits.


Premium Brand España SL, operates a returns policy in accordance with the EU Consumer Contracts Regulations which allows you to return any item within 14 days of receipt of delivery of your order.

To manage returns you can use the form enabled in the header of the website "RETURNS", specifying the details of the order and the reasons for the return to initiate the process. Please note that shipping costs incurred when returning your items during this period will be at your expense, unless the item is damaged or has been sent in error.

If an order was placed with a promotional discount on shipping, this may affect the amount of your refund if your total spend no longer exceeds the requirements of the delivery offer.

This policy does not extend to any item that has been opened or whose seal has been broken, nor does it include reimbursement for services performed by Premium Brand España SL as part of its contract (i.e. handling costs).

Items must be returned in perfect condition and in resalable condition. This policy does not affect your statutory rights.

If the item is determined to be damaged or defective, we will replace it or give you a full refund (including shipping and handling).

Please indicate which option you prefer. If you need a replacement, we will wait until we receive the defective product before sending a new one.

Please note that a refund is only applicable within the first 14 days after purchase.

After this time, and due to the nature of perishable products, we will not be able to proceed with any claim.

In the event that the item was delivered incorrectly, we have made a mistake in fulfilling your order, you will be refunded the full amount (including shipping costs).

Please note that all items that qualify for a full refund must:

- be in perfect condition and in resaleable condition.

- be accompanied by a copy of the delivery note or receipt.

While we are very careful when preparing the boxes, delicate items can occasionally be damaged in transit.

If you have received any damaged items, please accept our apologies and contact us as soon as possible so that we can arrange a refund or reship the item.

All claims must be made in writing, by sending us an email to: web@havanna.com.es, with pictures showing the damaged items, within 24 hours of receipt of the package.


If you find that any item is missing from your order:

First carefully check the entire contents of your package.

If you still cannot find the missing items, please contact us immediately so we can arrange a full refund or reship your items.

If you have received the wrong item(s):

Please contact us immediately so that we can ship the correct items.

We may ask you to return incorrect items. If this is the case, we will cover the return shipping costs.

This cancellation policy does not affect your rights when the problem has been caused by us, for example, if the products are defective or misdescribed.

These terms apply to your order. We reserve the right to change our terms and conditions at any time.

None of these terms affect your statutory rights and they are not diminished in any way.

If any term is held invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to the minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.

Protection of personal data

In accordance with the provisions of the regulations on protection of personal data, we inform you that the information you voluntarily provide when making any purchase, will become part of a file owned by Premium Brand España SL in order to manage your purchase, shipping, after-sales service and customer service. In addition, we will periodically send you information about offers of our products.

The basis for the processing of data is the performance of a contract. The data will be kept at least in accordance with the provisions of the tax and commercial regulations and in any case as long as you do not request their deletion.

We inform you of your right to file a complaint with the data protection authorities.

Please keep your personal data up to date, so that Premium Brand España SL can fulfill its obligation to keep them accurate and up to date.

The user agrees to provide truthful data and relating to his person, assuming any responsibility for the inaccuracy of the data and / or manipulation of data relating to third parties, as Premium Brand España SL will presume that the data have been provided by the owner of the same and that they are accurate and truthful.


These GTC are governed by Spanish law.

To resolve any controversy or dispute arising from the purchase of products on this website, the parties agree to submit to the courts or tribunals of BARCELONA, waiving both parties to any jurisdiction or jurisdiction to which they may be entitled, except for mandatory jurisdiction in the case of consumers and users, in which case the competent jurisdiction will be the one corresponding to their domicile.
